- Understand that produselele and services provided as free of charge for limited periods will be charged by 1si1 Professional Webhosting after the expiration of the offer on tariffs 1si1 Professional Webhosting.

Contract for products and services 1si1 Professional Webhosting

1. The contract

1. 1. Under this contract, 1si1 Professional Webhosting Customer agrees to provide hosting services in accordance with quality standard webhosting services.

1. 2. Customer can not provide services to third parties covered by this contract without prior written consent of Professional Webhosting 1si1.

2. Terms of service delivery.

2. 1. In accordance with the provisions of this contract, Professional Webhosting 1si1 will develop, install and activate the services covered by this contract, starting from the date on which Customer has provided domain name, but not earlier than the date on which payment confirmation service conducted by the client.

2. 2. Installation and configuration is considered closed and the service is considered to be functional when accepted client service put into operation, (confirming e-mail or fax). Installation and configuration is considered accepted by the client if it does not send a written notice to 1si1 Professional Webhosting, to the contrary, within 48 hours after installation and server configuration 1si1 Professional Webhosting sites.

2. 3. If the client only option for hosting services, transfer sites, popular databases, implementation of programs and web site images related to a fall in the Customer's exclusive duty.

2. 4. The operation of a sufficient capacity, 1si1 Professional Webhosting will provide operation in over 99% share of the server that will be found the site or sites specified in Annex 1.

2. 5. 1si1 Professional Webhosting shall not be liable for any interruption of the operation of its services, resulting from causes which are outside its control nor for damages the Customer may suffer from these causes. 1si1 Professional Webhosting shall not be liable for damages suffered by Client or Client partners for nefunctionalitatii 1si1 Professional Webhosting Server or Internet.

2. 6. 1si1 Professional Webhosting has the right to delete any information entered by Customer 1si1 Professional Webhosting server, which could affect its proper functioning or could lead to interruption of the server. Also, after having heard or discovered information or illegal activities 1si1 Professional Client Server Webhosting (for example, but not limited to: prohibited pornography, spam, copyright infringement, etc..) Has right to act to remove or block access to information or activity. Also 1si1 Professional Webhosting has the right to suspend the service provided under this contract for the period in investigating complaints received from third parties or authorities relating to alleged activities performed by the client 1si1 Professional Webhosting server. 2. 7. Duration of contract

The agreement is concluded for a period of at least 12 months from the date of payment.

By signing this contract, the Customer undertakes not to terminate this contract for a period of at least one year after its signing this period, the contract shall be deemed extended period of 12 months unless either party notify the other party 30 days before the expiry of the contract, intention to not continue the contract or to continue in other contractual conditions. Notification shall be made by fax, respecting the period of 30 days.

Test Card package contracts are for periods of one year, without the possibility of being extended.

3. Account and customer identification elements.

3. 1. 1si1 Professional Webhosting has the right to request any documents to prove identity, location and potential client's financial situation. Customer agrees to notify 1si1 Professional Webhosting for any changes in the information provided when signing the contract, occur during this contract, especially those changes on the registered office or residence, legal status or legal entity name.

3. 2. Customer access to certain services provided by Professional Webhosting 1si1 under this contract, is protected by a password. The client is advised not to disclose this password to anyone. 1si1 Professional Webhosting will not ask for your password in client accounts messages or phone calls.

3. 3. 1si1 Professional Webhosting is not responsible for damages due to disclosure of client recorded by him passwords and IDs to access our products or services provided under this contract, regardless of the damage.

4. Contract price

4. 1. Professional Webhosting 1si1 will offer customers products and services on the basis of the rates of packages required. Customer undertakes to pay the price of services provided, including price upon which the services are provided, and any other fees for admission to the optional services offered by Professional Webhosting 1si1.

4.2. By signing this contract, the Customer undertakes not to terminate this contract for a period of at least one year from the date of signature. When withdrawing from the Customer before the expiration of this contract period of one year from the date of its signing, he understands and accepts that the amounts paid as advance is not reimbursed.

4. 3. Professional Webhosting services 1si1 price is fixed in euros (EUR), excluding VAT and full payment will be made within 10 days of signing the contract by the client, in lei, including VAT, at the official exchange rate RON / EUR at invoice issue date.

4. 4. For a fee TestCard package installation. When switching to another package installation fee will be deducted from its price.

5. Pay the price

5. 1. Payment for products and services provided and performed under this contract will be based on proforma invoice issued by the Professional Webhosting 1si1 the date of signing this contract

5. 2. Proforma invoices, Customer will be issued by mail, fax or e-mail to the address specified in this contract. If the bill does not reach the Client for reasons not attributable 1si1 Professional Webhosting, Customer undertakes to pay the services 1si1 Professional Webhosting, at the rate of the day the order, at the addresses specified by 1si1 Professional Webhosting or bank transfer in Register Professional Webhosting 1si1 indicated within 10 days after ordering.

5. 3. Payment date will be considered the date on which the amounts were received by the bank where the account has 1si1 Professional Webhosting.

6. Delays in payment

6. 1. Failure to pay the amounts specified time will lead to penalties for late payment of 1% of the amount due for each day of delay until full payment of outstanding amount.

6. 2. For late payment of more than five (5) working days from the due date, 1si1 Professional Webhosting will discontinue providing customer service, until all arrears paid Client Payment. 1si1 Professional Webhosting reserves the right to apply equally to all active accounts by the same client, if the late payment occurred for only one account of that client.

7. Termination of the contract.

7.1. This contract terminated by agreement of the parties.

Invoking the cause of termination of this contract, shall notify the other party at least 30 days before the date on which termination is to have effect, the notification was send in by fax, dated, stamped and signed.

7.2. 1si1 Professional Webhosting may terminate this agreement without the need for formal notice and without any other formalities, in case:

a) If the customer does not pay invoices on time by the supplier, and will apply from 1% penalty for each day of delay but not more than 90 days. If after 90 days period does not understand customer bills to pay, the supplier has the right to terminate his contract without notifying the client.

b) The client loses credibility if repeated delays in paying bills;

c) Client Server Security 1si1 Professional Webhosting prejudice or trying repeatedly (with or without success) to obtain information that does not have a public character, or if the client load in the site or materials and any conflicting data with the Romanian legislation in force, or made, directly or indirectly through illegal actions and controversial 1si1 Professional Webhosting servers.

d) Customer violates any of the obligations which it assumed in this contract and does not comply within 2 (two) days of notification by the Professional Webhosting 1si1;

e) subsequently found that the closing date of the contract, the customer has submitted documents or false, incorrect or incomplete;

f) are initiated proceedings against the Customer's liquidation or bankruptcy, or sued for credit is due.

7.3. In all these situations, Clinetul understand and agree that due 1si1 Professional Webhosting, as damages, an amount equal to the price of this contract, damages, interest amounting to 50% of the contract, plus penalties of 1% per day delay the date of the first bills paid by the client.

8. Effects of termination

If this contract is terminated for any reason, Customer shall pay for the services provided and fees and monthly charges due prior to termination, including any amount due under Art. 9.

9. Abuse and inappropriate use of services 1si1 Professional Webhosting

9. 1. 1si1 Professional Webhosting has the right to demand repayment of sums paid by the Client as damages to third parties and the costs of paying these amounts, as well as damages, to cover full damages, including indirect costs and those due to third parties due to liability caused by acts 1si1 Professional Webhosting abusive or fraudulent tort of Customer.

9. 2. The client is directly and solely liable to third parties 1si1 Professional Webhosting or if their harm by the acts or deeds or acts inconsistent with this agreement or the Romanian legislation in force.

10. Confidentiality

10. 1. Throughout this agreement no party may disclose any of the terms of this Agreement without the prior consent of other parties.

10. 2. Client can not disclose to any third party any information relating to this Agreement, even after termination.

10. 3. Professional Webhosting 1si1 will make all efforts to preserve the confidentiality of customer data transferred through 1si1 Professional Webhosting server, the server will constantly monitor 1si1 Professional Webhosting and will stop any attempt of unauthorized access to customer data, to the extent that it is detected by 1si1 Professional Webhosting.

11. Amendments to Contract

11. 1. Professional Webhosting 1si1 Customer may request, in case of renewal of contract under Art. 2.7, renegotiating tariffs set initially by faxed notice, dated, signed and sealed ..

11. 2. If the client disagrees with the amendment of the Contract under Section 11. 1, it is able to withdraw the contract within 10 (ten) days of receipt of notification of contract changes, by registered letter with acknowledgment of receipt sent to 1si1 Professional Webhosting, other amendments are to be tacitly accepted.

12. Force Majeure

12. 1. Force majeure liability for non-exempt parts of all or part of their obligations.

12. 2. Force Majeure means any event independent of the will of the parties, unpredictable and inevitably occurred after the entry into force of this contract that prevents the parties to and execute, in whole or in part, its contractual obligations.

13. Liability

13. 1. 1si1 Professional Webhosting shall not be liable to the client, users or third parties for any damage, loss of profit, unrealized benefits, failure of business opportunities or other losses incurred by the customer, directly or indirectly as a result of misuse or improper products and services 1si1 Professional Webhosting.

13. 2. Client understands and agrees that it is not entitled to any refund of amounts paid or to pay damages of any kind would be, in case the server Bad functioning falls below the minimum threshold of 99% parked. In all cases, the customer may be granted up to an extension of the delivery of services over the term of this contract, with a period equal to the downtime of the servers below the guaranteed minimum of 99%.

14. Notifications

14. 1. Any notice shall be made in writing and faxed to the party to whom it is addressed to the address provided in this contract or the new address if it has changed and it was communicated.

14. 2. Notifications can be sent by any means calculated to ensure confirmation of receipt by the consignee.

15. Final

15. 1. This contract is governed by the Romanian legislation in force upon signature by the parties.

15. 2. Any dispute relating to the execution or interpretation of this Agreement shall be resolved mainly amicably. If such resolution is not possible, the dispute will be settled in the competent courts at the 1si1 Professional Webhosting.

15. 3. If the parties violate their obligations, not to exercise, by the suffering any damage, the right to request execution or cash equivalent of such obligation does not mean it's right or quit.

15. 4. Legal successors of the parties is subrogated to the rights and obligations under this Agreement.

16. Clause reseller.

16.1. Professional Webhosting 1si1 Customer support and encourage popular activity 1si1 Professional Webhosting services. In this respect 1si1 Professional Webhosting will provide customers a fee of the value of contracts concluded through mediation 1si1 Webhosting Professional Client. The commission will be established depending on the volume of contracts.

16.2. Professional Webhosting 1si1 will keep track of the fee due and the Customer will pay the threshold of 50 Euro by bank transfer within 6 months of the threshold.

16.3. For the benefit of art. 16.1 and 16.2, the 50 Euro, which entitles the customer to collect the fee to be achieved by the Customer during the 6 consecutive months. Customer undertakes to apply the threshold collection fee of 50 Euro.
